Terms of Use for Octo

These Terms of Use ("Terms") govern your use of the Octo app ("Octo", "the app"). By downloading or using Octo you agree to these Terms. If you do not agree, do not use the app.

Octo is provided by Peter Dominik Nils Lukas Schaefer, Hamburg, Germany (the "Provider", "we", "us"). Contact: peterschaefer444@gmail.com.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Octo on Apple devices you own or control, in accordance with the Apple Media Services Terms and Conditions and these Terms. You may not copy, reverse engineer, resell, or redistribute the app except as permitted by applicable law.

2. Your content and imported decks

Octo lets you import flashcard decks (for example .apkg files) that you supply. You are responsible for the decks and content you import and for ensuring you have the right to use them. We do not own your content, we do not review it, and imported decks are stored on your device. Do not import content you are not licensed to use.

Octo imports and reads deck files that you provide; it is not affiliated with, endorsed by, or connected to Anki or its developers. "Anki" is a trademark of its respective owner.

3. Word notes

Octo can write a note about a word using an AI model. The feature is optional: nothing is written until you ask for a note in a deck (see the Privacy Policy for how the card's text is processed).

AI-written content can be inaccurate, incomplete, or misleading. Notes, explanations, origins, memory hooks and example sentences are generated automatically and are not verified by us; the app labels them and links to a dictionary so you can check them. Do not rely on them for medical, legal, financial, safety-critical, or other consequential decisions. You use word notes at your own discretion.

You agree not to use the feature to generate unlawful content or to attempt to overload, abuse, or reverse-engineer the service.

4. Subscriptions (Octo Pro)

Octo offers an auto-renewing subscription that unlocks additional features.

5. Availability and changes

We may update, change, or discontinue features (including word notes and the free allowance) at any time. Optional server-dependent features (such as word notes) require an internet connection and may be subject to usage limits or temporary unavailability.

6. Disclaimer of warranties

To the maximum extent permitted by law, Octo is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that scheduling, imports, or AI output will be accurate or fit for any particular purpose. Nothing in these Terms excludes rights you have as a consumer that cannot be excluded under applicable law (including mandatory statutory warranty rights under German and EU law).

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, arising from your use of the app. Our liability for intent and gross negligence, and for injury to life, body, or health, and any other liability that cannot be limited by law, remains unaffected. Back up decks and data you cannot afford to lose.

8. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer-protection provisions of the country in which you reside.

Apple is not a party to these Terms and is not responsible for Octo or its content. As a subscription app on the App Store, Octo also operates under Apple's standard Licensed Application End User License Agreement.
