Terms of Use for Octo Chinese

These Terms of Use ("Terms") govern your use of the Octo Chinese app ("Octo", "the app"). By downloading or using Octo you agree to these Terms. If you do not agree, do not use the app.

Octo is provided by Peter Dominik Nils Lukas Schaefer, Hamburg, Germany (the "Provider", "we", "us"). Contact: peterschaefer444@gmail.com.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Octo on Apple devices you own or control, in accordance with the Apple Media Services Terms and Conditions and these Terms. You may not copy, reverse engineer, resell, or redistribute the app except as permitted by applicable law.

2. The vocabulary deck

Octo ships with its Mandarin vocabulary deck inside the app: the words, their readings, meanings, example sentences and recordings. The deck is provided for your personal study within the app. You may not extract, copy or redistribute it outside the app except as permitted by applicable law.

3. Word notes and stories

Octo can write a note about a word, and a short story from the words you have learned, using an AI model. Both are optional: nothing is written until you ask (see the Privacy Policy for how the card's text and your word list are processed).

AI-written content can be inaccurate, incomplete, or misleading. Notes, explanations, origins, memory hooks, example sentences, stories and quiz answers are generated automatically and are not verified by us; the app labels them and links to a dictionary so you can check them. Do not rely on them for medical, legal, financial, safety-critical, or other consequential decisions. You use them at your own discretion.

You agree not to use these features to generate unlawful content or to attempt to overload, abuse, or reverse-engineer the service.

4. Price

Octo is currently free of charge, with no subscription and no in-app purchase. Word notes and stories are subject to usage limits, which the app shows you when you reach them. We may introduce paid features in a future version; if we do, these Terms will be updated and nothing you have already received will be taken away.

5. Availability and changes

We may update, change, or discontinue features (including word notes, stories and their usage limits) at any time. Server-dependent features (word notes and stories) require an internet connection and may be temporarily unavailable.

6. Disclaimer of warranties

To the maximum extent permitted by law, Octo is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that scheduling, the deck's content, or AI output will be accurate or fit for any particular purpose. Nothing in these Terms excludes rights you have as a consumer that cannot be excluded under applicable law (including mandatory statutory warranty rights under German and EU law).

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, arising from your use of the app. Our liability for intent and gross negligence, and for injury to life, body, or health, and any other liability that cannot be limited by law, remains unaffected. Your study data lives only on your device; deleting the app deletes it.

8. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer-protection provisions of the country in which you reside.

Apple is not a party to these Terms and is not responsible for Octo or its content. Octo also operates under Apple's standard Licensed Application End User License Agreement.
